Police Seizure Abuse - The Loose Cannon.
Although I once defied the odds and got nought out of thirty in an open book multiple choice Chemistry test, leading to me studying law and not an agricultural science, Newton’s third law ‘for every reaction there is an equal and opposite reaction’, has always appealed to me, because at least on one level it applies to human and organisational behaviour and not just objects.
Thus when Police are affected by something they react.
Most readers would be familiar with the Edwards tragedy last year. Mr Edwards was granted a special Commissioner's Permit for a handgun, against the wishes of a gun club he had previously approached, and then he went oput and commited a murder suicide soon after. Further compounding the tragedy, his distraught former spouse committed suicide earlier this year.
Police did not blame themselves for granting the permit, and are now targeting anyone who shoots and who is involved in a Family Law break up.
Case in point, I am acting for a small dealer at present who is in the process of going through a break up with his spouse. The parties are separated under the one roof.
On my instructions his former partner was somewhat jealous because he was having a discussion and was actively engaged in play with his son. His wife’s mother suggested she call Police, which she proceeded to do.
Police attended, and as no threat was made, and there was no apprehension of violence, no AVO was issued.
Nevertheless, my client’s licence was suspended. The reason on the suspension was ‘child at risk’- yet there was on these facts no evidence of this. The only thing that happened that night that would have been scary to a child was the arrival of two Police Officers after the child’s bed time - although I stress that in this particular situation the officers behaved commendably well, and only followed instructions.
Not every child in a break up is a child at risk, and if Police wanted to target children at risk their attention would be better spent visiting shopping centres and rounding up truanting children during the day, and getting tired drivers off the road.
As you may be aware, Police policy of seizure, for a ‘cooling off period’ of 28 days, does not appear to have any statutory basis and any seizure of firearms needs to comply with Firearms Act 1996 or the Law Enforcement (Powers and Responsibilities) Act 2002.
The Police power to suspend a Firearms licence is set out in paragraph 22 of the Firearms Act 1996, and I have set it out below.
22 Suspension of licence
(cf APMC 6, 1989 Act s 35)
(1) The Commissioner may, if the Commissioner is satisfied there may be grounds for revoking a licence, suspend the licence by serving personally or by post on the licensee a notice:
(a) stating that the licence is suspended and the reasons for suspending it, and
(b) requesting that the person provide the Commissioner with reasons why the licence should not be revoked.
(1A) If a licence is being suspended because the Commissioner is satisfied that there may be grounds for revoking the licence under section 11 (5A), the notice suspending the licence is not required:
(a) to state the reasons for the suspension, or
(b) to include any request that the licensee provide the Commissioner with reasons why the licence should not be revoked.
(2) The Commissioner must suspend a licence in accordance with this section if the Commissioner is aware that the licensee has been charged with a domestic violence offence within the meaning of the Crimes (Domestic and Personal Violence) Act 2007 or the Commissioner has reasonable cause to believe that the licensee has committed or has threatened to commit a domestic violence offence within the meaning of that Act.
(3) A suspended licence does not authorise the possession or use of firearms during the period specified in the notice suspending it.
Whilst not relevant, I shall set out section 11(5) below for your convenience
11(5) A licence must not be issued to a person who:
(a) is under the age of 18, or
(b) has, within the period of 10 years before the application for the licence was made, been convicted in New South Wales or elsewhere of an offence prescribed by the regulations, whether or not the offence is an offence under New South Wales law, or
(c) is subject to an apprehended violence order or interim apprehended violence order or who has, at any time within 10 years before the application for the licence was made, been subject to an apprehended violence order (other than an order that has been revoked), or
(d) is subject to a good behaviour bond, whether entered into in New South Wales or elsewhere, in relation to an offence prescribed by the regulations, or
(e) is subject to a firearms prohibition order, or
(f) is a registrable person or corresponding registrable person under the Child Protection (Offenders Registration) Act 2000.
Turning to the Law Enforcement (Powers and Responsibilities) Act 2002 which again relevantly provides:
20 Relevant offences
The following offences are relevant offences for the purposes of this Division:
(a) indictable offences,
(b) an offence against section 93FB of the Crimes Act 1900,
(c) an offence against the Weapons Prohibition Act 1998, the Firearms Act 1996, or a regulation made under either of those Acts,
(d) an offence against a provision of Part 2 of the Explosives Act 2003.
21 Power to search persons and seize and detain things without warrant
(cf Crimes Act 1900, ss 357, 357E, Drug Misuse and Trafficking Act 1985, s 37)
(1) A police officer may, without a warrant, stop, search and detain a person, and anything in the possession of or under the control of the person, if the police officer suspects on reasonable grounds that any of the following circumstances exists:
(a) the person has in his or her possession or under his or her control anything stolen or otherwise unlawfully obtained,
(b) the person has in his or her possession or under his or her control anything used or intended to be used in or in connection with the commission of a relevant offence,
(c) the person has in his or her possession or under his or her control in a public place a dangerous article that is being or was used in or in connection with the commission of a relevant offence,
(d) the person has in his or her possession or under his or her control, in contravention of the Drug Misuse and Trafficking Act 1985, a prohibited plant or a prohibited drug.
(2) A police officer may seize and detain:
(a) all or part of a thing that the police officer suspects on reasonable grounds is stolen or otherwise unlawfully obtained, and
(b) all or part of a thing that the police officer suspects on reasonable grounds may provide evidence of the commission of a relevant offence, and
(c) any dangerous article, and
(d) any prohibited plant or prohibited drug in the possession or under the control of a person in contravention of the Drug Misuse and Trafficking Act 1985,
found as a result of a search under this section.
22 Power to seize and detain dangerous articles on premises
(cf Crimes Act 1900, s 357)
A police officer who is lawfully on any premises may seize and detain any dangerous article that the police officer finds on the premises, if the police officer suspects on reasonable grounds that the dangerous article is being or was used in or in connection with the commission of a relevant offence.
Premises include vessels, vehicles, aircraft and other places.
The difficulty for Police here is that while a firearm is a dangerous article within the meaning of s21(2)(c) there is no relevant offence, nor is there any suspicion on reasonable grounds that the article is or was used in commission of an offence (s22).
After realising that they were on shakey grounds a Sergeant rang my client, alluded to gaol, and referenced the following alleged offences, none of which are supported by available evidence.
- That my client was in possession of 14 unregistered firearms. This allegation was denied. My client had completed all PAB28 and 31 paperwork as required by legislation as required and had forwarded these to the Registry by Registered Post. My client also completed his quarterly return with respect to these entries and forwarded the quarterly return to the Registry by Registered Post. Apparently, Police wish to hold my client responsible for processing tardiness at their Registry.
That my client was in possession of a number of prohibited firearms specifically firearms fitted with a folding stock. Allegation admitted. My client is authorised by virtue of his dealer licence to possess prohibited firearms no 11 of Sch 1 of the Firearms Act 1996, item 11 are any firearms fitted with a folding stock.
- That my client was informed he would be asked why one firearm had a defaced serial number. Upon entering details of all firearms acquired by my client the physical serial number of the firearm was sighted at all times when making these entries. My client can answer no explanation why one has a defaced serial number he questions if part of a serial number may be partially obscured by a stock. I requested further particulars.
- The Sergeant informed my client that his decision to suspend my client in the morning of 9 May 2019 was supported by an allegation involving matrimonial property. On the 8 May 2019 attending Police referred to this as a civil matter, and it was not raised as a complaint until the afternoon of the 9 May 2019. For this reason, this allegation was not raised on the Suspension Notice and had no bearing upon the decision to suspend.
My criticism is with a Police Policy in practice in respect to domestic situations that exceeds the law, and that involves the seizure of firearms without probable cause merely on suspicion of a domestic break up.
Just because Firearms ownership is a privilege and not a right, does not mean that privilege is subject to unfettered discretion by Police to seize firearms or suspend licences without appropriate due process.
When I first came to Australia, I was amazed how far this country has progressed since it was a penal colony, a mere couple of hundred years ago. However the longer I practice law, the more convinced I am that my assumption is wrong, for certainly in terms of Police attitude, this state is still a Penal Colony.

might have saved them.

Human beings only have two ways to deal with one another: reason and
force. If you want me to do something for you, you have a choice of either
convincing me via argument, or force me to do your bidding under threat of
force. Every human interaction falls into one of those two categories, without
exception. Reason or force, that’s it.
In a truly moral and civilized society, people exclusively interact
through persuasion. Force has no place as a valid method of social interaction,
and the only thing that removes force from the menu is the personal firearm, as
paradoxical as it may sound to some.
When I carry a gun, you cannot deal with me by force. You have to use
reason and try to persuade me, because I have a way to negate your threat or
employment of force. The gun is the only personal weapon that puts a 100-pound
woman on equal footing with a 220-pound mugger, a 75-year old retiree on equal
footing with a 19-year old gangbanger, and a single gay guy on equal footing
with a carload of drunk guys with baseball bats. The gun removes the disparity
in physical strength, size, or numbers between a potential attacker and a
defender.
There are plenty of people who consider the gun as the source of bad
force equations. These are the people who think that we’d be more civilized if
all guns were removed from society, because a firearm makes it easier for a
mugger to do his job. That, of course, is only true if the mugger’s potential
victims are mostly disarmed either by choice or by legislative fiat–it has no
validity when most of a mugger’s potential marks are armed. People who argue
for the banning of arms ask for automatic rule by the young, the strong, and
the many, and that’s the exact opposite of a civilized society. A mugger, even
an armed one, can only make a successful living in a society where the state
has granted him a force monopoly.
Then there’s the argument that the gun makes confrontations lethal
that otherwise would only result in injury. This argument is fallacious in
several ways. Without guns involved, confrontations are won by the physically
superior party inflicting overwhelming injury on the loser. People who think
that fists, bats, sticks, or stones don’t constitute lethal force watch too
much TV, where people take beatings and come out of it with a bloody lip at
worst. The fact that the gun makes lethal force easier works solely in favor of
the weaker defender, not the stronger attacker. If both are armed, the field is
level. The gun is the only weapon that’s as lethal in the hands of an octogenarian
as it is in the hands of a weightlifter. It simply wouldn’t work as well as a
force equalizer if it wasn’t both lethal and easily employable.
When I carry a gun, I don’t do so because I am looking for a fight,
but because I’m looking to be left alone. The gun at my side means that I
cannot be forced, only persuaded. I don’t carry it because I’m afraid, but
because it enables me to be unafraid. It doesn’t limit the actions of those who
would interact with me through reason, only the actions of those who would do
so by force. It removes force from the equation…and that’s why carrying a gun
is a civilized act.

Another Home Invasion. Victim or Criminal, Your Choice!
Another home invasion where a young lady ran to a house for help with men chasing her. The young man in the house gave her shelter & called the police. The police told them that they were under staffed & could not help them but to let them know how it turned out!!!
Three men broke down the door & attacked the man, he had armed himself with a kitchen knife because it was illegal for him to keep anything in the house specifically for self defence, lethal or non lethal. Minutes later two of the three intruders were dead from stab wounds, the man fighting frantically for his life against three much stronger larger attackers.

‘We’ve got you
now’: ironic last words before fatal Queensland home invasion.
They were told
by the only officer in the town of Ayr, 15 minutes away, that there were no
police available and to “just see how
it went”.
“Three of them
smashed through the door so Dean thought they were probably going to kill him
and her. It’s completely destroyed him.”

Police refused to say whether it would review the local roster and declined to
answer questions about the number of officers on duty on the night of the
deaths.
We don't know how this will turn out for the victim of this home invasion, if the court decides that this kitchen knife was kept solely for self defence in the room where these young adults had retreated to for safety, then the charge could be murder. If they believe that the knife was taken from it's place in the kitchen & taken to another room, then he may not be charged.

What Are You Continually Feeling Anxious About?
I feel as though I am under threat from our government & our
local government 24/7. This is not good, this is not the way it was supposed to
be. We are NOT free & we no longer have a voice. We are no
longer a democracy, we are not governed, we are ruled by a dictatorship
government. The worse thing of all about this is that the majority of
Australians don’t care or don’t want to know. The city people are satisfied with
the way things are, they bury their heads in the sand. The fact that our government is
involved in the Genocide of West Papuans by the Indonesian
government means nothing to the majority of Australians! I find
it very worrying & sickening this lack of caring about other people.
Sometimes I feel as though we are only a couple of steps away from achieving
a “Hunger Games” society!!!

More Lies and Misinformation from Gun Control Australia!!!

As I understand it there has been no weakening of our present gun laws in Australia, & from what I understand, the blame for this last shooting where a father shot his two teenage children lies with the NSW Firearms Registry & a certain gun club, both failed to follow proper procedure & because of this a person who should not have been allowed to own a gun was in fact issued with an "H" class restricted gun licence!!! But who will pay the price for this incompetence? Well us of course, the law abiding licenced gun owners of Australia!!! And what are we going to do about that? Well nothing of course, this is Australia not America!
I have in the past started two petitions regarding poor firearms policy that I wanted changing, & very few licenced gun owners could be bothered to sign those petitions. So, the ball is now in your court. You can continue to sit back & say "she'll be right mate" & lose further freedoms & human rights, or you can get off your backsides & start petitioning the government & fighting for our Human Rights!
"Gun Control Australia (CGA)" may well be concerned with public safety, but the problem is that they know very little if anything about firearms, & they can't see past their mandate to disarm law abiding licenced gun owners. Instead of looking at the problem sensibly & using some common sense, they continue down the same path, inconveniencing law abiding licenced gun owners & ignoring the fact that criminals will ALWAYS HAVE GUNS!
Gun violence like any other violence is a societal problem, & it will not be solved with further inadequate pointless gun control. We, the law abiding gun owners are doing all we can, we have our guns locked up, even though it means that land owners can no longer do their job of controlling feral animals properly & protecting our livestock. The predator is long gone by the time we get the gun safe keys, unlock the safe, unlock the other safe with the ammunition, & get out of the house!!! What you could be doing though is writing a decent sensible policy for the control of firearms that works for everyone concerned. We can't do the impossible, we can't stop criminals from committing crimes, but we could make sure that the penalties for criminals using guns FIT THE CRIME! We could fix all the useless mistakes in the present firearms legislation, & we could petition for some decent sensible self defence laws!!!
People need to stop depending on the government & the police service for their own safety & the safety of their families. We NEED to be able to protect ourselves. Those two teenagers should have been able to defend themselves, their Mother should have been able to protect them, but our present laws made this ILLEGAL!!! Possessing any

I suggest you all stop talking about these unjust laws & do something about it. Samantha Lee said we have "a well-resourced, well-connected NRA-style gun lobby here in Australia", she is wrong!!! We don't have anyone who is powerful enough to reverse the present gun laws or to stop further unjust useless gun laws. We need to take responsibility & do something about this before it is too late!!!

Immigration, War in the South China Sea, Unemployment, Foreign ownership or Islamic ownership? We all get on with life but the big issues getting more relevant every day.Originally, we were a British Colony, Then a satellite of the USA, but that is now being fiercely challenged by two forces, internally by (population growth) Islam, and externally by China’s incursions into the South China sea and by massive land and port purchases.

million licenced law abiding firearm owners will get immediate national
coverage, but they must speak out loud and clear that they guarantee that they

A. For the individual right of law abiding citizens to own firearms,
B. To end long arm registration, allowing ownership of semi autos and
pumps, and
C. Ensure that all law abiding citizens can use the Right of Self
Defence as a reason to obtain the firearms that they believe are suitable for
this need.
Then add to that same contract the promise to,
Stop All Islamic Immigration to Australia, from any country.
Not even for a holiday.
(Return all that have not got Australian citizenship.)
Stop All Importation of Islamic Refugees,
(Return all to their country of origin immediatetly).
Stop All Foreign Aid.
Stop the $33 Billion in Aboriginal Aid.
Stop all immigration (except for aged parents)
(except for special skills requested by our industry).
Stop GST and place 20% Tariff on Imports and 10% Bounty on all
Exports.
Stop all Free Trade Agreements.
Stop all Australian commitment to the UN.
Stop all Hala certificates and payments.
Stop all 457 work visas.
Stop All Foreign Ownership of Property.
(If it’s not owned by Australians. Government makes compulsory
purchase order.)
Stop Carbon Tax, It’s a slave tax
Open all Mosques to public and police scrutiny.
Introduce that
All Foreign born naturalised citizens who are convicted of murder, or rape or assault if not sentenced to death, transport to Macquarie Island for life. (It is an Australian Antarctic territory)
We want small government that lets us get on with our lives we just want to be left alone.
Any party that gets those points across will win Australia, lets hope one of them does before its too late.
